For those that are curious.
IL SB0290 Passed both houses and governors desk, August 24, 2009
(11) Who takes impressions of human teeth or places his
or her hands in the mouth of any person for the purpose of
applying teeth whitening materials, or who takes
impressions of human teeth or places his or her hands in
the mouth of any person for the purpose of assisting in the
application of teeth whitening materials. A person does not
practice dentistry when he or she discloses to the consumer
that he or she is not licensed as a dentist under this Act
and (i) discusses the use of teeth whitening materials with
a consumer purchasing these materials; (ii) provides
instruction on the use of teeth whitening materials with a
consumer purchasing these materials; or (iii) provides
appropriate equipment on-site to the consumer for the
consumer to self-apply teeth whitening materials.
So it appears from this bill that if a consumer goes in and has a "shop owner" tell them how to apply the product, where to sit for the light to work and how to turn on the light. (or whatever the procedure is) they are ok, as long as they disclose they are not a dentist and do not ever cross the lip barrier to enter the oral cavity. Correct??

It's how the mall operators of teeth whitening do it in my state without a dentist.
-they wear white lab coats (just like the girls at the Clinique cosmetic counter)
-they hand the patient a mirror
-they squirt an OVER THE COUNTER strength teeth whitening gel into a tray
-hand it to the patient to insert themselves
-turn on a light
-set a timer
-charge $100
The"patient" can go 2-3x whiter-the same as Crest white strips.

The April 2010 issue of SKIN INC contains an interesting article on new legislation in a number of states regarding TEETH WHITENING services. Apparently, Alabama, Hawaii, Illinois and Missouri all have new legislation that regulates the types of professionals who may perform teeth-whitening procedures. Check this out before you add this service to your med spa menu of services and save yourself some anguish.
