Physician to Physician Discussions > MD rent a room in salon

Does anyone know the laws in Georgia regarding a physician renting a room in a salon or dayspa for botox/fillers. Without fee splitting but using the salons scheduling. What are the steps needed to begin? Form a corporation, malpractice, business license, etc. Already have certification and training.

It depends on what you are doing , your licensure and the zoning of you establishment. First injections of botox, filers is the practice of medicine so only MD,DO, RN, PA can inject a person. I say this because you mentioned the certification and training so I don't know if you are a doctor with a course in injectables or an esthetician who wants to have a MD on site and believes they can now inject.

As a physician its important to have the malpractice insurance so tell your carrier what you plan to do and where. Since Botox isn't a procedure that is invasive the sterility of a salon should not be a problem however some carriers want you to inject only in a medical office so I would check to see if the building is zoned for medical. They worry about waste but all your waste should be contained in a sharps box ( needles, syringes and occasional bloody sponge).

Renting the room isn't a problem splitting the fees are so its important that the rent be comparable to normal rents in a room that size. Ie. a 100 sq foot room an $30/ft would be $300/mo you could do day rates as a schedule which would give you the room and a little spare for the owner of the spa. I hate to disillusion you but there isn't a lot of profit margin in botox, it may seem that way but the vial when purchased legally ( Allergan not Foreign) is $560 and it only lasts a few days.

I recommend you contact the medical licensing bureau in GA to find the exact laws there regarding MD's in other locations regarding any extra licensure, In my state the regular license covers you.
